Dans le contexte du 20^ème anniversaire de l’intégration de la Hongrie à l’Union européenne, l’Ambassade de France en Hongrie, l’Institut français de Budapest et le Centre des Sciences Sociales (HUN-REN) organisent un colloque consacré à la protection des droits fondamentaux dans l’Union européenne le mardi 4 juin 2024 à 9h00 au Centre des Sciences Sociales de Budapest (H-1097 Budapest, Tóth Kálmán street 4.).

Dans la perspective de construire une Union européenne sans cesse plus étroite, fondée non seulement sur une coopération économique mais aussi sur des valeurs communes, l’Union européenne a adopté la Charte des droits fondamentaux le 7 décembre 2000 à Nice. Dotée d’une simple valeur déclarative à son adoption, elle est devenue juridiquement contraignante en 2009. Le respect des droits politiques, sociaux et économiques qu’elle protège s’impose ainsi aux institutions, organes et agences de l’Union européenne, ainsi qu’à ses États membres lorsqu’ils mettent en œuvre le droit de l’UE. Encore peu connue du grand public, les institutions européennes se réfèrent régulièrement à cet instrument, et les autorités nationales s’en saisissent de plus en plus.

En réunissant d’éminents praticiens, universitaires et spécialistes du droit européen venus de France et de Hongrie, ce colloque visera d’abord à retracer l’évolution de la Charte des droits fondamentaux, de sa conception à nos jours. Il permettra ensuite d’analyser le cheminement jurisprudentiel de la Cour de justice en matière de droits fondamentaux, puis d’interroger la notion d’identité constitutionnelle des Etats membres à l’aune de la Charte.

In light of the 20th anniversary of Hungary's integration into the European Union, the French Embassy in Hungary, the French Institute in Budapest and the Centre for Social Sciences (HUN-REN) are organising a conference on the protection of fundamental rights in the European Union on Tuesday 4 June 2024 at 9.00 am at the Centre for Social Sciences in Budapest (H-1097 Budapest, Tóth Kálmán street 4.).

With a view to building an ever closer European Union based not only on economic cooperation but also on shared values, the European Union adopted the Charter of Fundamental Rights on 7 December 2000 in Nice. Although the Charter was merely declaratory when it was adopted, it became legally binding in 2009. Respect for the political, social and economic rights it protects is thus binding on the institutions, bodies and agencies of the European Union, as well as on its Member States when they implement EU law. Although still little known to the general public, the European institutions regularly refer to this instrument, and national authorities are making increasing use of it.

Bringing together eminent practitioners, academics and specialists in European law from France and Hungary, this conference will begin by tracing the evolution of the Charter of Fundamental Rights from its conception to the present day. It will then analyse the development of the case law of the Court of Justice in the area of fundamental rights, and examine the concept of the constitutional identity of the Member States in the light of the Charter.
