Colloque : « Tradition, constitution et intégration européenne »
Les 23-24 septembre 2021, à l’Institut du Droit (Tóth Kálmán utca 4, 1097 Budapest) et en ligne
L’Union européenne se compose de 27 Etats membres ayant chacun leurs propres Constitutions ou Lois fondamentales, auxquelles s’ajoutent les traités européens fondateurs. Tout cela forme un système juridique complexe, dans lequel s’entremêlent et interagissent en permanence les ordres juridiques nationaux et européen.
Du fait de leurs caractéristiques particulières (historiques, géographiques, politiques, linguistiques, etc.), les Etats (à l’instar des personnes) possèdent une identité propre, unique. Les éléments essentiels de cette identité sont protégés dans la Constitution de chaque Etat : c’est qu’on appelle l’identité constitutionnelle. Il incombe à la Cour de Justice de l’UE d’assurer la bonne application et l’harmonisation du droit européen dans tous les Etats membres (conformément au principe de suprématie), tout en garantissant le respect des traditions constitutionnelles nationales. Parallèlement, l’Union construit son identité communautaire, inspirée de ses valeurs qui prévalent également dans chacun des Etats membres.
Qu’est-ce que l’identité constitutionnelle ? Comment s’articulent les traditions constitutionnelles nationales et le droit européen ? Quelles sont les perspectives des Etats membres et celle de l’Union européenne ? Quel dialogue constitutionnel la CJUE entretient-elle avec les cours constitutionnelles nationales ?
Ce colloque, organisé par l’Institut du Droit du Centre de recherches en sciences sociales de Budapest et l’Institut français en Hongrie, et soutenu par les Ambassades de France et des Pays-Bas en Hongrie, a pour objectif d’approfondir l’étude du concept d’identité constitutionnelle et d’analyser les perspectives des Etats membres et de l’Union.
Il rassemblera des experts hongrois, français, néerlandais, allemands et polonais.
Traduction simultanée en français et en anglais.

The 27 Member States of the European Union have each their own Constitutions or Basic Laws. In top of that, the EU is governed by founding treaties. Thus, the national and the European legal orders are constantly intermingling and interacting, forming a complex legal system.
Because of their particularities (historic, geographic, political, linguistic, etc.), States (just as individuals) have their own identity, which is unique. The essential elements of this identity are protected in the Constitution of each State, the so called Constitutional Identity. The Court of Justice of the EU is responsible for harmonising and ensuring the effective enforcement of EU law in all the Member States (in compliance with the principle of supremacy) in accordance with the national constitutional traditions. At the same time, the EU is building its own community identity, inspired by its values which also prevail in each and every Member State.
What is Constitutional Identity? What is the relationship between EU law and the national constitutional traditions? What are the perspectives of the Member States and of the EU? What does the dialogue between CJEU and the national constitutional courts entail?
This conference, organised by the Institute for Legal Studies of the Centre for Social Sciences and the French Institute, and supported by the French and the Dutch Embassies in Hungary, aims at studying in depth the concept of Constitutional Identity and analysing the perspectives of the Member States and the EU.
It will bring together Hungarian, French, Dutch, German and Polish experts.
Simultaneous translation in French and English will be available.
